Sure the death penalty has a deterrent effect. No one has come back from the dead to commit a capital crime. That goes for those who never committed a capital crime in the first place.
Whoops! Well you can't make an omlet without breaking an egg nor achieve deterrance without a innocent life or two...or three...or....
